  • Typographical Errors

    In the event that a Data Path, inc. product is mistakenly listed at an incorrect price, Data Path, inc. reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Data Path, inc. reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Data Path, inc. shall issue a credit to your credit card account in the amount of the incorrect price.

  • Term; Termination

    These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Data Path, inc. without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

    Data Path, Inc. may provide notices, communications, updates, disclosures, or other required information to the customer by any reasonable and reliable method of communication. This may include, but is not limited to, delivery via email to the address provided by the customer, posting of general notices on Data Path, Inc.’s website or customer portals, physical mail sent to the address on file, or any other communication method deemed appropriate and reliable based on the nature of the notice.

    It is the customer’s responsibility to ensure that all contact information provided to Data Path, Inc., including email addresses, physical addresses, and phone numbers, remains accurate and up to date. Data Path, Inc. shall not be held responsible for any failure of delivery, delays, or missed communications resulting from incorrect, outdated, or incomplete contact information provided by the customer.

    Notices shall be considered received and effective upon transmission or posting, regardless of whether the customer has actively accessed, read, or responded to the communication, unless otherwise required by applicable law or explicitly stated in a separate written agreement.

  • Miscellaneous

    Your use of this site shall be governed in all respects by the laws of the state of Ohio, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Data Path, inc. products) shall be in the state or federal courts located in Hamilton County, Ohio.   • Validity of Quote

    All quotes are valid for 10 days from
    the date issued unless otherwise stated. Pricing and availability are subject to change after this period.



  • Pricing & Availability

    All pricing is based on current manufacturer and distributor costs and is subject to change due to market fluctuations, supply chain constraints, or manufacturer price adjustments. Product availability is not guaranteed until order confirmation. We will do our best to communicate any possibilities of foreseen issues.



  • Scope of Work

    Quoted services (e.g., configuration, asset tagging, enrollment, delivery) are based on the specifications outlined in the quote. Any changes or additional requests may result in revised pricing.

  • Taxes & Shipping

    Prices do not include applicable sales tax, shipping, freight, or handling unless explicitly stated. Your tax form and W-9 must be provided for tax exemption.



  • Order Acceptance

    Quotes do not constitute a binding agreement. Orders are only confirmed upon receipt of an authorized Purchase Order (PO) or written approval.



  • Lead Times

    Estimated lead times are provided as a guideline and are subject to change based on manufacturer or supplier timelines.



  • Errors & Omissions

    We reserve the right to correct any
    typographical, pricing, or specification errors.



  • Payment Terms

    Payment terms are Net 15 or Net 30 from the invoice date, depending on the terms agreed upon at the time of sale or as otherwise stated in writing. Applicable payment terms may be outlined on the quote, purchase order, invoice, email correspondence, contract, or other written agreement between Data Path, Inc. and the customer. Unless otherwise agreed to in writing by Data Path, Inc., all invoices are due according to the stated payment terms. Failure to remit payment within the agreed terms may result in late fees, finance charges, delayed shipments, suspension of services, or changes to future credit terms.

  • Late Payment

    Payment is due according to the terms stated on the invoice unless otherwise agreed to in writing. Any past due balances may be subject to a finance charge of 1.5% per month, or the maximum amount permitted by applicable law, whichever is lower. Data Path, Inc. reserves the right to delay, suspend, or withhold products, services, deliveries, support, or future orders on accounts with overdue balances until payment arrangements have been made and the account is brought current.

    Customers are responsible for all costs associated with the collection of overdue balances, including reasonable attorney fees and collection expenses where permitted by law. Continued failure to remit payment may result in additional restrictions on account activity or credit terms.

  • Accepted Payment Methods

    Data Path, Inc. accepts several forms of payment to accommodate customer needs and streamline the payment process. Accepted payment methods include Automated Clearing House (ACH) transfers, wire transfers, and pre-approved credit terms established through a credit application and approval process. Credit terms, when extended, are subject to ongoing account review and compliance with agreed-upon payment conditions.

    Credit card payments may also be accepted; however, they may be subject to a processing fee or convenience fee, where permitted by applicable law and card network regulations. Any applicable fees will be disclosed prior to processing the payment and may vary based on the type of card used or transaction amount.

    Customers are encouraged to utilize ACH or wire transfer methods when possible, as these options help ensure faster processing and reduce potential delays or additional costs. All payments must reference the appropriate invoice number or account information to ensure proper application of funds. Failure to properly reference payments may result in delays in posting or account reconciliation.

  • Purchase Orders

    All orders submitted to Data Path, Inc. must be accompanied by a valid and authorized purchase order (“PO”) unless otherwise approved in writing. The purchase order must accurately reflect the quoted pricing, product descriptions, quantities, configurations, shipping information, applicable taxes, and all agreed-upon terms and conditions associated with the transaction. Customers are responsible for ensuring that the PO matches the approved quote, proposal, or written agreement provided by Data Path, Inc.

    Any discrepancies, missing information, unauthorized changes, or inconsistencies between the purchase order and the approved quote or agreement may result in delays in order processing, procurement, scheduling, shipment, delivery, or project implementation until clarification or correction is received. Data Path, Inc. reserves the right to request revised documentation or written approval prior to processing an order.

    Submission of a purchase order constitutes authorization to proceed with the order and acceptance of the pricing, products, services, and terms outlined by Data Path, Inc. Customers are responsible for obtaining all necessary internal approvals prior to submitting a PO.

  • Order Changes & Cancellations

    Orders submitted to Data Path, Inc. cannot be canceled, modified, or changed once the order has been submitted to the manufacturer, distributor, or supplier, or once processing, fulfillment, staging, or procurement has begun. This includes, but is not limited to, changes in quantity, configuration, model specifications, shipping details, or delivery timelines. Because many products are custom-ordered, specially configured, or sourced directly from manufacturers, orders may immediately enter a non-cancellable and non-returnable (NCNR) status upon processing.

    In limited circumstances, cancellation or modification requests may be reviewed on a case-by-case basis; however, approval is not guaranteed and is subject to manufacturer and supplier policies. Any approved cancellations, returns, or order changes may be subject to applicable restocking fees, cancellation fees, shipping costs, or other charges incurred by Data Path, Inc. or its vendors.

    Customers are encouraged to carefully review all quotes, purchase orders, and order confirmations prior to submission to ensure accuracy and completeness, as responsibility for order details rests with the customer once the order has been accepted and processed.

  • Shipping & Risk of Loss

    All shipments from Data Path, Inc. are considered FOB Shipping Point unless otherwise explicitly stated in writing on the quote, invoice, or other contractual agreement. This means that ownership, title, and risk of loss or damage to goods transfer from Data Path, Inc. to the customer at the point the shipment is handed over to the carrier for delivery.

    Once the shipment has been released to the carrier, the customer assumes full responsibility for the goods during transit, including any loss, damage, delay, or theft that may occur. Data Path, Inc. is not liable for damages incurred during shipping once the carrier has taken possession of the products.

    Customers are encouraged to inspect all shipments immediately upon arrival and to document any visible damage, shortages, or discrepancies directly with the carrier at the time of delivery. Any shipping-related claims must be filed promptly in accordance with carrier requirements and must also be reported to Data Path, Inc. within the specified reporting period to assist in resolution.

    Unless otherwise agreed in writing, all shipping terms remain FOB Shipping Point, and customers are responsible for any freight charges, insurance, or additional shipping-related costs unless explicitly included in the original agreement.

  • Returns & Warranty

    All returns must be pre-approved by Data Path, Inc. and require a valid Return Merchandise Authorization (RMA) prior to being shipped back or accepted. Any unauthorized returns may be refused or returned to the customer at their expense. Hardware returns are subject to the original manufacturer’s return policies, eligibility requirements, and approval processes, which may vary by product and vendor. In addition, approved hardware returns may be subject to restocking fees, return shipping costs, or other applicable charges depending on the condition of the product and the terms of the original purchase.

    Warranty-related claims are governed strictly by the applicable manufacturer warranty terms and conditions. Data Path, Inc. will assist in facilitating warranty claims where applicable; however, final determination, repair, replacement, or denial of warranty coverage is made by the manufacturer. Customers are responsible for complying with all manufacturer warranty procedures, including proper documentation and return requirements.

    All service-based work, including but not limited to configuration, installation, setup, enrollment, deployment, imaging, and related professional services, is non-refundable once the service has been scheduled, initiated, or completed. Because labor, time, and resources are allocated specifically to each engagement, no refunds will be issued for completed services. Any exceptions must be approved in writing by Data Path, Inc. management prior to service execution.

  • Installation & Services

    The customer is responsible for providing complete, accurate, and timely information, data, credentials, system details, and any required access necessary for Data Path, Inc. to properly perform the requested services. This includes, but is not limited to, network access, user credentials, system configurations, licensing information, physical or remote access to equipment, and any other documentation or resources reasonably required to complete the scope of work.

    Any delays, interruptions, or inability to perform services caused by incomplete, inaccurate, outdated, or missing information provided by the customer may result in delays to project timelines, service delivery, and scheduled work. Data Path, Inc. will not be held responsible for delays resulting from such circumstances.

    If additional time, labor, or resources are required due to incorrect or incomplete customer-provided information, including rework or repeated site visits, Data Path, Inc. reserves the right to assess additional charges. These charges will be billed at standard service rates unless otherwise agreed to in writing.

    Customers are encouraged to review all submitted information carefully and ensure readiness prior to scheduled service dates to avoid delays and additional costs.

  • Product Acceptance

    Products sold by Data Path, Inc. may include new, refurbished, or manufacturer-certified equipment depending on the terms of the order. Minor cosmetic imperfections, including small scratches, scuffs, packaging wear, or variations in finish that do not affect the functionality or performance of the product, may be present and are considered acceptable unless otherwise specified in writing.

    Customers are responsible for inspecting all products upon delivery. Any claims regarding shipping damage, shortages, defects, incorrect items, or concerns related to product appearance must be reported to Data Path, Inc. within [5] business days of receipt. Failure to notify Data Path, Inc. within this timeframe will constitute acceptance of the products as delivered.

    Product acceptance occurs upon delivery, installation, or use of the product, whichever comes first. Once products have been accepted, returns, exchanges, or claims will be subject to applicable return merchandise authorization (RMA), manufacturer warranty terms, and Data Path, Inc. return policies.

    Data Path, Inc. reserves the right to repair, replace, or otherwise resolve any verified product issue at its discretion and in accordance with manufacturer and distributor policies.



  • Limitation of Liability

    To the maximum extent permitted by applicable law, Data Path, Inc. shall not be held liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to the use of products or services provided. This includes, but is not limited to, damages for loss of profits, loss of revenue, loss of business opportunities, loss of anticipated savings, reputational harm, or business interruption, even if Data Path, Inc. has been advised of the possibility of such damages.

    Data Path, Inc. is also not responsible for any loss, corruption, or recovery of data, regardless of cause, including but not limited to hardware failure, software issues, installation, configuration, network disruptions, or service interruptions. Customers are solely responsible for maintaining appropriate backups of all data and systems prior to, during, and after the performance of any services.

    In no event shall Data Path, Inc.’s total liability for any claim arising out of or related to products, services, or agreements exceed the amount actually paid by the customer for the specific product or service giving rise to the claim. Some jurisdictions may not allow certain limitations of liability, and in such cases, this limitation shall apply to the fullest extent permitted by law.

  • Force Majeure

    Data Path, Inc. shall not be held responsible or liable for any delays, interruptions, or failure to perform its obligations where such delays or failures arise from circumstances beyond its reasonable control. These circumstances may include, but are not limited to, acts of God, natural disasters (such as floods, earthquakes, hurricanes, or fires), pandemics or public health emergencies, labor disputes, strikes, war, terrorism, civil unrest, governmental actions or restrictions, changes in laws or regulations, transportation delays, shipping carrier issues, supply chain disruptions, or delays caused by manufacturers, distributors, or third-party vendors.

    In the event of such a force majeure occurrence, Data Path, Inc. will make reasonable efforts to mitigate the impact and resume performance as soon as practicable; however, timelines, delivery dates, and service schedules may be extended without liability. Any estimated delivery or completion dates provided are not guaranteed and are subject to change based on external conditions.

    Customers acknowledge that such events may affect availability of products, pricing, and lead times, and agree that Data Path, Inc. shall not be liable for any resulting losses, damages, or expenses incurred due to such delays or inability to perform under these circumstances.

  • Open Box Return Policy

    To ensure the quality and integrity of our products, open box returns are not accepted. We encourage customers to carefully review product specifications and compatibility prior to purchase.

    Exceptions may be considered on a case-by-case basis due to unforeseen circumstances or unique situations. Approval of any exception is at the sole discretion of our team and may be subject to restocking fees, manufacturer guidelines, product condition requirements, or other applicable factors.

    Please contact us directly if you experience an issue with your order, and we will work to determine the best possible resolution.

  • Standard Shipping

    Our average delivery time is 3 business days. Please contact us if you need an exact time estimation prior to placing your order. All orders arrive within 1-6 business days after shipment. Standard shipping will ship UPS ground or USPS. Shipping rates depend on the selected shipping speed and weight/size of the items.

  • Expedited shipping


    In certain situations, we’re able to provide expedited shipping options for faster delivery. If you select an expedited service, we’ll ensure your order is processed and shipped as quickly as possible to meet the quoted delivery window. Please note that if your order arrives on or before the estimated delivery date provided at the time of purchase, expedited shipping charges are non-refundable.

  • Freight Forward- Outside Continental US

    We currently ship to the continental United States. data path, inc. does not ship to any international countries (including Canada) or other United States territories such as Guam and the Virgin Islands.  We do not ship to any address that UPS can not deliver to.  We do not ship to APO, PO Box addresses or Freight Forward shipping companies.

  • Other Details

    All orders shipping to an Apartment, Condo or Multi Unit will require Adult signature.

    Most orders ship within 1 business day from the time of order. Our order cutoff time is 10AM Eastern Daylight time zone. In the event that an Item is
    out of stock, you will be notified within 1 business day.

  • Returns

    data path, inc. offers a 30 day return from the date of the order. Some exclusions apply. All returns must have a RA# issued from Data Path Inc. Please email us at megan@datapathusa.com. When you receive your RA# email from us, it will include the proper address to send the return. In most cases full refunds are issued unless there is intentional damage, missing items, the items has been used, not in original manufacturing box, the item is listed in our excluded returns. All returns are at the discretion of data path, inc.

  • Refunds

    Refunds are issued once the merchandise is returned and received by Data Path Inc. Returns will be photographed and videoed as they are received. Data Path Inc. will verify the condition of the return to determine the refund amount. Refunds are at the discretion of Data Path Inc. Returns are subject to restocking fees and other deductions if merchandise is no longer in salable condition or in the original condition shipped. A restocking fee (20%) will be applied if the item is returned in an AS-NEW condition, including all packing materials. If the item is missing packing materials or accessories a 50% restocking fee will apply. If we receive back substantially missing product or incorrect product, no refund will be accepted.

  • Excluded Items 

    Due to their fragile nature, certain items are not eligible for return once received. This includes all televisions. In addition, due to manufacturer restrictions, the following products cannot be returned once they have been opened or removed from their original packaging: monitors, computers and notebooks, video projectors, video games, DVDs, computer games, software, CD duplicators, and activated satellite receiver units (such as DirecTV, Sirius, and XM). For these items — including TVs, laptops, monitors, projectors, PCs, and other electronics — the manufacturer’s warranty applies for all defects. Please note that toner and ink are also non-returnable once shipped.

  • Defective Items

    Defective items other than those mentions in "Excluded Items" above may be returned within 30 days of delivery. Due to the complexity of internet transactions, please contact us for exchanges. Email scott@datapathusa.com. If an item looks to be intentionally damaged to earn a return there will be no refunds issued. If an item has been broken by the purchaser there will be no refunds issued

  • Damaged Items 

    In the rare event that an
    item arrives damaged, refuse shipment if the damage is external or notify us within 24 hours if the damage is concealed. WE CAN NOT ACCEPT DAMAGE CLAIMS AFTER 24 HOURS from delivery date. Data Path Inc. at its sole discretion, will either ship a replacement or issue a full refund when and if the claim is settled with the carrier. Items shipped to freight forwarders must be inspected
    for damage prior to forwarding shipment. No damage claims will be accepted once an item leaves a freight forwarder.

  • Fraudulent Orders

    All orders placed with Data Path Inc. undergo a thorough fraud analysis before processing. This review helps protect both our customers and our company from unauthorized transactions or potential misuse of payment information. If an order triggers any fraud indicators during this review, it may be subject to additional verification or immediate cancellation. Data Path Inc. reserves the right, at its sole discretion, to cancel any order that appears fraudulent or suspicious in nature. This process ensures a safe and secure purchasing experience for all of our customers.

  • Jewelry

    30 day returns. Product weights are approximate. Our total diamond weight may have a +/-5% tolerance. All prices on this web site are subject to change without notice. In the event a product is listed at an incorrect price
    due to typographical,  or technical error, Data Path Inc/ Diamond Place
    reserves the right to cancel any such order placed with an incorrect
    price. 

     

  • Credit Card Payments

    We gladly accept major credit cards, including MasterCard, Visa, and American Express, for your convenience. Please note that a discretionary 3% service fee may apply to orders paid by credit card, particularly on discounted or specially priced items. This fee helps offset the processing costs associated with credit card transactions and allows us to continue offering competitive pricing. The service fee, when applicable, will be clearly reflected on your invoice or quote prior to payment.
